These terms and conditions govern the relationship between you and Catch-22 (Us). Including the use of this website, any purchases you make from us and our promotions.
By accessing, browsing or using this site, you acknowledge and agree to these terms and conditions. You acknowledge that you have read, understood and accepted these terms and agreement.
We reserve the right to change these terms and conditions without notice.
Pricing Policy
All prices are shown in New Zealand dollars and are inclusive of GST. All prices are correct at time of publication, however we reserve the right to alter prices for any reason. If this should happen after you have ordered a product, we will contact you prior to processing your order.
Product Availability
Products listed on our website are, to the best of our knowledge, available for purchase. If for any reason we are unable to supply a product for your order we will contact you to arrange a refund or alternative product if available.
Refunds and exchanges
We will comply with our obligations under the Consumer Guarantees Act 1993 (CGA). This includes your rights of exchange and refund as set out in the CGA.
Except where required by the CGA, we will only offer a refund or exchange on goods sold if:
1. The refund or exchange is requested within 5 days of receipt; and
2. The product including any packaging is in such a condition that the product can be on sold for full price
Requests for refunds or exchanges must be made to [email protected]
Products will need to be returned to the Catch-22 warehouse from which they were dispatched, in their original condition and packaging. Notification of a return needs to be made to [email protected] within 5 days of receipt by you, we will then let you know the address where the products need to be returned.
Once we have received the goods and ascertained that they and their packaging are still in a condition that they can be resold for the full original retail price, you will receive a full refund less any courier and packaging charges. Any courier costs you incur to return products to us will not be refunded unless we have made an error.
Courier/postage costs are generally non-refundable for undelivered, unclaimed or returned packages unless we have made an error.
Privacy Policy
At Catch-22 we recognise your right to confidentiality and are committed to protecting your privacy.
We use a secure server for credit card transactions to ensure absolute confidentiality. Under no circumstances is your credit card information used for anything other than orders. We do not give, rent or loan any identifiable personal information to any third parties unless you have authorised us to do so or we are legally required to do so.
Typographcial Errors
We are not responsible for any typographical errors contained in this website. The information, prices and discounts in this website are subject to change without notice.
Intellectual property
We reserve all our rights to intellectual property in this website and the items we sell. This includes any trademarks, copyrights, designs, patents or any other intellectual .
You must not use any information in this website, including design, images, brands and trademarks, without our express written permission.
Exclusion of Negligence
We exclude any liability in negligence (either in contract or trot) in relation to the performance of our products or any other fact or matter relating to our products
Delivery
Title is retained by us in all products sold until payment is received in full. Subject to your rights under the CGA, liability for all items passes to the purchaser on dispatch.
Delivery times given on this website are indicative only. Your order will be dispatched from the Catch-22 Warehouse provided they have the items to fulfil your order in stock.
Catch-22 will not be liable for any failure to observe these delivery times but will try and contact you by phone or email if any late deliveries are anticipated. You understand and agree that you shall not be entitled to withdraw or modify any commitment made for the purchase of products from this website once that commitment has been made for any reason, including without limitation, due to any delay in delivery.
If however, delivery has not happened after 30 days from the indicative delivery date, the buyer may, at their election, treat the failure to deliver as a terminating contractual event. In such an event Catch-22 will refund any payment made to it in respect of that particular order.
If Catch-22 is unable to source the particular product you require, Catch-22 will contact you, the buyer, and inform you of the general date of availability. If you, the buyer, are unhappy with that, Catch-22 will provide a refund of the money paid for that order.
Loss or Damage in Transit
Catch-22 will take every care in packing and dispatching your purchase but is not responsible to the buyer or any person claiming through the buyer for any loss or damage to goods or products caused by any event of any kind by any person, whether or not Catch-22 is legally responsible for the person who caused or contributed to that loss. Catch-22 is not responsible for any loss of items that are wrongfully signed for and accepted by a third party.
3rd Party Advertising, Hyperlinks & Offers
The site may have third party advertisements, referral buttons and other pointers to websites operated by third parties. Catch-22 has no control over these sites and is therefore not responsible for any materials and contents linked to our website. While this information is offered in good faith, it must be understood that Catch-22 does not endorse any of these sites or their advertising and is not responsible for any goods you purchase from them.
Warranties
The CGA, the Fair Trading Act 1986, and other statutes may impose warranties, conditions or obligations upon us which cannot by law (or which can only to a limited extent by law) be excluded. Other than as expressly provided for in these Terms, we exclude all such imposed warranties, conditions or obligations to the extent permitted by law and exclude any warranty, condition or obligation imposed or implied under common law, equity or otherwise.
Governing law
This agreement is governed by the laws of New Zealand and is subject to the exclusive jurisdiction of the New Zealand courts.

Catch-22 reserves the right to refuse service, terminate accounts, remove or edit content or cancel orders at their sole discretion. Any orders cancelled by Catch-22, but paid for, will receive a full refund.

Catch-22 reserves the right to change any advertised price before accepting an order. All products are subject to availability and may be withdrawn at any time. If we are unable to fulfil your order, you will be offered an alternative or given a refund for the unavailable product.
